Transfer Miles Program Agreement

 Participation in the Transfer Miles program ("Transfer Miles Program") is subject to the Terms and Conditions stated herein, as such Terms and Conditions may change, from time to time. UAL Loyalty Services, Inc., a wholly owned subsidiary of UAL Corporation, the parent of United Air Lines, Inc. and responsible for the marketing, advertising, and promotion of the Mileage Plus Program ("ULS"), at its sole discretion, reserves the right to approve or disapprove a Mileage Plus® program member's ("Member"), participation in the Transfer Miles Program.
  1. By completing and submitting the accompanying order form ("Order Form") or by providing your credit card number for the transfer of Mileage Plus miles ("Miles") for posting to another Member's Mileage Plus account, you acknowledge and accept the Terms and Conditions stated herein, as such Terms and Conditions may change, from time to time. You further acknowledge that you will be charged US $0.015 per mile, plus a US $35 processing fee per transaction or as otherwise set forth on the Order Form. The transfer of miles to one or more persons in one transaction will incur the US $35 processing fee only once. A Member may transfer miles to a maximum of 3 people in one transaction. Once a mileage transfer is requested, all fees are non-refundable. ANY TRANSFER OF MILES PURSUANT TO THE TRANSFER MILES PROGRAM IS FINAL.
  2. All requests to transfer Miles from one Member's account to a recipient Member's account orders are subject to acceptance by ULS and program fees and mileage rates subject to change. An order will be deemed accepted by ULS when ULS sends written confirmation of the order to transferring Member via the email address provided on the Order Form. The transfer and use of Miles is subject to the rules, regulations, terms and conditions of the Mileage Plus program published from time-to-time, and available at www.united.com. Mileage Plus program rules, regulations, terms and conditions are subject to change without notice. All terms and conditions of the Mileage Plus program are incorporated by reference into this Agreement as if fully set forth herein.
  3. Your submission of an Order Form and credit card number for the transfer of Miles authorizes ULS, or its agent, Crew Marketing International, Inc. ("Crew"), to charge the credit card that you provided under the Transfer Miles Program for the amount stated, based on the number of Miles you are requesting to transfer. All charges and related handling fees for Miles transferred through the Transfer Miles Program website should appear on your monthly credit card statement. In the event of any mileage or financial discrepancy, payment calculations under shall be based upon data maintained by ULS or its agent, and the data in the records of ULS or its agent shall take precedence over the data in any other records.
  4. All amounts paid by the Member under this Agreement are exclusive of sales, use or privilege taxes, or tax-like charges, fees or similar liabilities. Miles are sold in U.S. dollars. All transfer fees for Miles transferred using the Transfer Miles Program are non-refundable.
  5. Miles can be transferred in increments of 1,000 miles, with a minimum transfer of 5,000 miles per recipient, to up to 3 recipients per transaction. Transferred Mileage Plus Miles are applicable for all Mileage Plus awards. Transferred Mileage Plus miles do not count toward elite status qualification. All mileage transfers are final and cannot be reversed. Each Member is limited to transferring no more than 60,000 miles from his/her account and no recipient may receive more than 15,000 miles from any other Mileage Plus account or combination of accounts in any calendar year. Any Miles beyond this limit will not be transferred from Member's account or posted to any recipient's account, even if payment has been remitted for such Miles and ULS has no obligation to reimburse such remitted amounts.
  6. The transferred Mileage Plus miles will automatically be deducted from your Mileage Plus account and deposited into the Mileage Plus account you identified within 48 hours. In order to transfer miles, an intended recipient needs be enrolled in the Mileage Plus Program and provide you with his or her Mileage Plus account number and email address. Both you and the recipient will receive email notifications of your transfer, listing you as the person who transferred the miles. When you provide the email address of an individual to whom you are transferring your Mileage Plus miles, Mileage Plus will send an email to that individual that will include information about the transferred miles along with your name and email address and you grant to Mileage Plus or its agents consent to use your name and email address for the purpose of sending such email to the individual to whom you are transferring your Mileage Plus miles.
  7. Any improper usage of Miles shall be grounds for immediate confiscation and forfeiture of such Miles, and may be grounds for the forfeiture of all Miles in the Member's account and the Member's expulsion from the Mileage Plus program.
  8. The Miles transferred through the Transfer Miles Program will not expire, provided recipient of such Miles earns or redeems Miles at least once every 18 months.

Miles accrued, awards issued and miles transferred are subject to the rules of the United Mileage Plus program.
